This often creates confusion: in your wholesale warehouse inspections are rare, but once you deliver to a client (bar, restaurant, or shop) the goods are already in circulation \u2014 and that\u2019s where problems may arise.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1-1024x683.jpg\" alt=\"\" class=\"wp-image-1763\" srcset=\"https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1-1024x683.jpg 1024w, https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1-300x200.jpg 300w, https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1-768x512.jpg 768w, https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1-1200x800.jpg 1200w, https:\/\/redparalela.eu\/wp-content\/uploads\/2025\/09\/sancion-por-no-etiquetado-de-productos-1.jpg 1536w\" sizes=\"auto, (max-width: 709px) 85vw, (max-width: 909px) 67vw, (max-width: 1362px) 62vw, 840px\" \/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Who can seize and sanction?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Food control responsibilities are transferred to the <strong>autonomous communities<\/strong>, usually through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Health or Food Safety Inspection Services (regional health departments).<\/li>\n\n\n\n<li>Regional consumer or public health agencies.<\/li>\n\n\n\n<li>In some cases, <strong>municipal inspectors<\/strong> (local public health).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Ministry of Health coordinates criteria, but enforcement is regional.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How high are the fines?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Minor:<\/strong> \u20ac600 to \u20ac3,000.<\/li>\n\n\n\n<li><strong>Serious:<\/strong> \u20ac3,001 to \u20ac15,000.<\/li>\n\n\n\n<li><strong>Very serious:<\/strong> up to \u20ac600,000 in cases of health risk or repeat offenses.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Beyond the fine, seizure means you <strong>cannot sell the product until labeling is corrected<\/strong>, with the associated economic and reputational damage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What the law says (Regulation 1169\/2011)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Full text in Spanish (BOE): <a href=\"https:\/\/www.boe.es\/doue\/2011\/304\/L00018-00063.pdf?utm_source=chatgpt.com\">download here<\/a><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 8 \u2013 Operator\u2019s responsibility<\/strong><\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe food business operator responsible for the food information is the one under whose name or business name the food is marketed.\u201d<br>\ud83d\udc49 If you are an importer or parallel distributor, <strong>you are responsible for ensuring the label is applied and compliant<\/strong>.<\/p>\n<\/blockquote>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 9 \u2013 Mandatory information<\/strong><\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Name of the food, list of ingredients, allergens, net quantity, expiry date or minimum durability, storage and use conditions, business name and address of the responsible operator in the EU, country of origin (when required), production lot, and alcoholic strength (&gt;1.2%).<\/p>\n<\/blockquote>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 12 \u2013 Availability and location of information<\/strong><\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMandatory food information shall be available and easily accessible for all foods.\u201d<\/p>\n<\/blockquote>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 13 \u2013 Presentation of information<\/strong><\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMandatory food information shall appear in a prominent place, easily visible, clearly legible, and indelible. It shall not be hidden, obscured, or separated by other indications or images.\u201d<br>\ud83d\udc49 This rules out handing out loose labels: the information must already be affixed to the package at the time of circulation.<\/p>\n<\/blockquote>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 15 \u2013 Language<\/strong><br>In Spain, Spanish is mandatory. In regions with a co-official language, that language may also be required.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Box, sales unit, and loose labels<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Wholesale box\/unit:<\/strong> if this is the unit sold to the HORECA channel and the items inside are already compliant, labeling the box is sufficient.<\/li>\n\n\n\n<li><strong>Consumer units (bottles, cans):<\/strong> must be re-labeled if they don\u2019t comply (e.g., imports without Spanish).<\/li>\n\n\n\n<li><strong>Sign in the establishment:<\/strong> does not replace labeling on the package, it only serves as extra information.<\/li>\n\n\n\n<li><strong>Handing loose labels to the client:<\/strong> <strong>not legally valid<\/strong>. If an inspection occurs before the retailer applies them, the fine is for the wholesaler.
